Section 160 & Schedule 1 — explicitly permits government entities (CPWD, NHAI, Railways, GeM, and all PSUs) to accept insurance surety bonds in place of bank guarantees. This 2017 amendment was the watershed moment: it opened the door for insurance-backed guarantees across government procurement.
IRDAI (Surety Insurance) Guidelines, 2017
The Insurance Regulatory and Development Authority issued detailed guidelines governing surety insurance products in India. These cover: underwriting criteria, claims handling, indemnity agreements, insurer solvency, and consumer protection. All 15 licensed insurers issuing surety bonds must comply.
NHAI Policy Circular 3.1.41 (amended Feb 2025)
Latest version: explicitly mandates that NHAI projects accept insurance surety bonds for bid, performance, mobilisation, and retention securities. Replaces bank guarantees entirely. This circular is the most-referenced by Indian contractors and obligees.
CPWD O.M. (Office Memorandum) — GFR Compliance
Central Public Works Department follows GFR 2017. All CPWD tenders now permit (and many mandate) surety bonds. Similar clarity issued by MoRTH (Ministry of Road Transport & Highways).

Why these regulations matter: They give obligees (government bodies, PSUs, private developers) legal cover to accept surety bonds instead of bank guarantees. Without these guidelines, obligees might hesitate. With them, surety bonds are standard, not exotic.

What the Guidelines Guarantee

1. Obligee legitimacy: The obligee can legally demand a surety bond instead of cash collateral or bank guarantee, per the regulations. No longer a gray area.

2. Insurer solvency: IRDAI ensures all licensed surety insurers maintain minimum solvency ratios and capital reserves. Your insurer won't collapse mid-claim.

3. Claims handling: IRDAI guidelines mandate standardized claim procedures, timelines, and dispute resolution. If the insurer acts unfairly, there's regulatory recourse.

4. Transparent underwriting: Insurers must disclose rating criteria, premium calculation, and indemnity terms upfront. No hidden fees.

5. Consumer protection: IRDAI regulates grievance redressal. If you have an issue with your surety bond issuer, IRDAI has a complaint portal.

FAQ on Regulatory Compliance

Are all surety bond insurers IRDAI-licensed?
Yes. All 15 surety insurers in India (Bajaj Allianz, ICICI Lombard, etc.) are IRDAI-licensed and regulated. They follow the same guidelines and solvency rules.
Can a private obligee refuse a surety bond even though it's GFR-approved?
Legally, yes — private contracts aren't bound by GFR. But most private developers accept surety bonds now because it's standard in the industry. If they refuse, you can educate them on GFR compliance.
What if an obligee rejects your surety bond citing "regulatory issues"?
Unlikely. The regulations clearly permit it. If they cite a specific circular or guideline, cross-check with that document or contact Rakshati — it's likely a misunderstanding about the bond format, not legality.
Can IRDAI intervene if an insurer wrongfully denies a claim?
Yes. If you believe an insurer has wrongfully denied a valid claim, you can file a grievance with IRDAI. They investigate and can direct the insurer to pay.
